Tesco employee sues customer

I read with interest the articles on both the Tesco and Postoffice employee sueing the customer. Could the customers not argue that it is the responsibilty of the companies providing the service for failing to carryout an appropriate risk assessment of the properties to ensure that their where no risks to there employees. and if any risks where present that these were brought to the attention of the owner to correct prior to receiving deliveries.
