We have a factory shift who work on Monday to Friday who this year we will allowing to take Monday 27th and Tuesday 28th December off as lieu bank holidays.

We also operate a shift that only works on a Wednesday to Friday. As no bank or lieu bank holidays fall on their normal shifts are we discriminating against them by not allowing them any additional time off ?

Any advice appreciated on how you would treat this

There is no statutory right to bank holidays. However, by allowing the Monday to Friday shift to take bank holidays in lieu, you are creating a situation whereby the Wednesday to Friday shift will feel unfairly treated.

If the Wednesday to Friday shift is made up of part-timers they may compare themselves to the Monday to Friday shift (who if they are full-timers) may cause you problems in relation to unfavourable treatment of part-timers.

Suggestion is to treat both the same and give appropriate bank holiday entitlement.

We would treat part-time and full time staff equally.

Presuming that the staff working the Wednesday to Friday shift are working 60% of the hours of the Monday to Friday shift they would receive 60% of the Bank Holiday entitlement of your full time staff.

Should the number of Bank Holidays falling within that shift exceed their pro-rata Bank Holiday entitlement then they would have to take that amount from their Annual Leave entitlement.

Where the number of Bank Holidays is less than
their entitlement then this is added to their Annual Leave entitlement.

This ensures part-time and full staff are paid the same rate for the job pro-rata to the hours they work.
