Does anybody have any guidance on Age Discrimination.

We have recently moved onto a competency framework, but Line Managers are still responsible for writing Job Descriptions/Person Specs which we check.

They are putting down "3 Years Experience etc" on Person Specifications. I am a bit worried about how we are going to be able to justify this when the new legislation comes in. Any Help would be appreciated.

The requirement should be "objectively justified" which according to the legislation should be a "proportionate means of achieving a legitimate aim". You should ask your line managers to explain what the actual job requirements are and why the 3 year qualification is necessary. Perhaps the requirement could be redrafted to refer to the fact that the candidate would need to demonstrate certain key skills/aptitudes etc. rather than be related to service.

Please ignore the rubbish being talked about this subject
there is no need to justify at the lower end of the experience level and 3 years experience would be easy to justify and very hard to criticise unless it was for a school-leaver

I would be happy to give you some guidance re your job descriptions/person spec. You are right to be concerned re "3 Years Experience" etc, and your organisation should be using the competencies.
