Is a failure by an organisation to carry out these an act of discrimination?


As I understand it under the Race Relations Act, if a race equalities impact assessment is not done on say a re-organisation of a public sector organisation, the decision to proceed with the re-organisation can be held to be a breach of the RR Act and the CRE can ask for the decision to be set aside.

I am not an expert on the public sector duty to build their duties into vitually everything they do but a failure to do so does not make it illegal


An obvious failure to do may possibly lead to an inference of direct discrimination or indirect discrimination but do not build up your hopes
