Every member of the staff where I work has received 3.75% pay increase except myself. I received 2.79%. All staff had been told orally that they would receive 3.75% and it was not based on performance or scale. Please advise how I should approach HR in gaining the same amount of pay increase as the rest of staff. I work for a boarding school as a Facilites Supervisor and the school has charity status.

The best approach would be to verbally request a meeting to discuss why you were not awarded the same pay rise as everyone else. This can be an informal meeting at the outset and should hopefully be able to resolve the issues in question. In the alternative, if you are not happy with the outcome, you should raise a formal grievance in writing, which would have to be dealt with in accordance with your employer's grievance procedure and/or the statutory dispute resolution procedures. You may wish to consider taking legal advice at this point, which can be obtained free-of –charge via the CAB to preclude expense. Your employer must be able to show that they had fair and objective reasons for the discrepancy in your pay-rise but, ultimately, should you still not be satisfied with the outcome, your only option would be to resign and claim constructive dismissal via an Employment Tribunal. However, you should certainly take legal advice before doing so. |

I would also consider if there is sexual discrimination here - Education is overwhelmingly female and if all staff getting the preferential rate are female then you have an automatic case. this amounts to an effective pay cut against colleagues and pay cuts should only be for reasons of clear underperformance. Consult Union/Legal advice and make the point calmly and fairly and you should be OK. |
