I was wondering if anyone has a policy on random breath testing at work? 


We have listed in our diciplinary policy that being incapacitated whilst at work through drugs or alcohol is gross misconduct, but we do not have a specific alcohol at work policy.


We would like to be able to request random breath tests from our staff and I was wondering if we will need to issue a specific policy to support this, and also what the implications are against the business for random breath testing, for example, would an employee have the right to refuse, or would we need to give notice?


Any help would be appreciated.

Hello Zoe,


I hope I am not too late in replying to this for you, there are many issues with any policy implementation that is important to be checked with a legal firm.  We do have an annual Employment Protection Scheme here at SA Law, where we could assist with both the writtain content for these schemes and have protection insurance directly via the firm for all Employment issues.
