We took on 2 part-time employees when my business partner and I opened our shop in October. After less than a month one of them announced that they would be needing (probably 6 weeks) sick leave in early '08 as they had to have a minor but disabling operation. They clearly knew about this when they came for interview but said nothing. This means that I will have to pay sick leave AND employ someone to cover - not an uncommon situation for a small business owner I guess. I assume there is nothing to be done about this - that it is a moral/ethical problem rather than a legal one! Just appreciate your comments. |

Hi How many people do you employee in your business? If the employee had disclosed this at his/her interview would you have offered him/her a job? Applicants are not obliged to disclose such information at an interview, nor are employers allowed to ask discrimnatory questions. Aswell as being a moral/ethical problem, this also falls under the legal remit, namley the Disability Discrimination Act, more so if the employee is likely to be 'disabled' for a few weeks after the op as you suggest. Do they have contracts of employment? If so what does it state about sick pay?If you do pay sick pay and he/she qualifies for it then you will have to pay it. If not then it would be unpaid leave for 6 weeks. Hope this helps with the thought process! |
