Just after some advice on a restructuring issue i am facing. We have taken a department and split it into 2 with the recruitment (currently) of a new manager open to internal applicants. We have changed the reporting structure for one sub-manager, and he feels hard done by. Is there any legal implecations for making cosmetic changes to someones role, but keeping the same level of responsibility, T&C's, etc etc. I am seeking some advice from the legal point of view?

I am a solicitor and I have recently dealt with a similar issue on behalf of a client.


Ego's are very easily bruised in a situation like this but if the change is truly only cosmetic then there should be no legal implications. A change in reporting structure is not sufficient to be characterised as a change to a persons duties or to the nature of their role so they can not, legitamately, claim constructive unfair dismissal or a redundancy payment. The difficulty you have is in managing the expectations and complaints of a disgruntled employee which can be dangerous because, despite the fact there is no legitimate claim, employees in that situation can act irrationaly.
