My employer is undergoing a re-structure.

My current post will be redundant. I have been informed that there is an alternative post for me. Since being told this another post has become available which I feel is more suitable for me.

My employer has an assimilation process so I enquired if I could claim assimilation rights and was told no.

My employer has indicated that the post is going to be advertised internally and I believe they are going to allow agency staff to apply.

I have a very strong suspicion that if the agency person applied they would be appointed.

I wondered if this was legal in such circumstances, should permanent employees be given first chance of being appropriately placed before considering the circumstances of agency workers?
