I work in Manufacturing and been with the company for 2 months. Our ops work on a 3-week rolling shift pattern and work on average between 38 & 45 hours per week.


The holiday year runs from 1st April - 31st March. It transpires that one of our employees hasn't taken any holidays (for years in the past I believe we've paid these holidays off) and it looks like he's waiting for the pay out. 


However we've communicated that we won't making such a pay out.


Now I remember that employers have a responsibility to ensure employees take 20 days holiday per year but I seem to remember that being based on 5 day working week.


Can anyone advise me on this matter?
