Does a company have to carry out the probationary review within the 6 months or can it over run by a week or so? I ask as I was on holiday when my review was due and my employer has set the date for the next week 10 days over due.

Giles,

The probationary period is there to that you settle into the company ok and that you like, they like you and your work is up to the required standard.

If a company is running probationary periods correctly, they should be reviewing your progress throughout the period, and not just in one review at the end of the period, so if the probationer were to be dismissed it would not come as a shock to them and their poor performance has been highlighted throughout the period, thus giving them the chance to meet the required standard.

In your case you were away, so a little difficult to conduct it without you. Should have done it before you went, and now by rights if they dismiss you are technically out of your probation period and so give you full notice. However, you are under a yr's service, so no rights for unfair dismissal, just a discrimination case.

I would say that there's not an issue with your performance, otherwise the meeting would have been arranged long before now and you would have gone.

Shouldn't worry too much.

Hope that helps.
