Gross Misconduct H&S Teresa 16/03/2008 17:38 teresa hills@ fmrec co uk

Hi

I hope someone can help me.  My husband works for a well known hotel chain in London at a 5* hotel.  He is the maintenance manager and manages a team of engineers/decorators etc... who look after all of the facilities within the hotel.  He was called into his HR office on Friday at 5.15 and told that he was suspended for gross misconduct.  With an investigation meeting on Tuesday this week.  that would be just over a days notice.

He is being investigated for breach of H&S rules.   The eye bolts were not serviced as they should have been.  (these are things that the window cleaners lock onto)  Apparantly a new contractor has been assigned and when checking the paperwork he noticed that it was not up to date and pointed this out.

The hotel has a loss prevention director and a general manager who have overall responsibility for H&S within the hotel and a head Housekeeper who manages the contracts for the contract cleaners although my husband organises the contractors to come in.

If he is the only person to be suspended and investigated is this allowed or right according to the law.  He has signed no documentation to say that he is taking responsibility for the H&S within his job role.  Is there anyone who can help us and who should we be talking to?

Please help.

Thanks Teresa

Presumably as maintenance manager, he would have responsibility for maintaining the eyebolts and therefore his position would encompass this duty?

the eyebolts are used by the window cleaners and not his department the contract for the window cleaners is managed by the head housekeeper.  All of the building H&S is managed by the loss prevention director.  The primary function of his job is general maintenance of the building, things like decoration, plant machinery, kitchens etc...
