I work with a local authority. They decided to restructure in which my role dissapears. I was given the opportunity to attend an interview for a post in competition with my boss. My boss got the job. I was told that I will have to be doing a lower grade role. My salary is frozen for 2 years while I perform this role after which my salary significantly drops. I am in the second year and there have not been much other job opportunities. My question: I understand that I can be made redundant, but are they allowed to cut my salary as result of reassigning me to a new role? I have not signed any agreement and not required to do so. I want to know whether I have a case to fight. Thanks Tina

Tina,

The process you have gone through is not uncommon with local authorities, in that they have a re-org, and then rather than redundancy you get a role at a lower grade, and your salary is protected for a certain amount of time. Its normally 3 to 5 yrs.

During this time your salary will mark time, or be 'red circled' as its known.  If you have not found a role, which looks like will be the case then the protection scheme usually allows for you grade to be reduce to the substantive role you are performing. This is legal - provifing they consult with you through the whole process.

You may not have signed anything, but in part agreed to it when you took the new role rather than redundancy, and this all should have been confirmed in writing.

Also, I would be very surprised if the Local Authority does not have a Salary Protection Policy covering these situations, which would have been agreed with their unions, and is applicable to all staff.

You should have been made aware of it and given a copy so you know what they and you are working to.

I would ask for a copy of the policy and see where you stand and take it from there.
