The answer is yes and no - really depends on what happened and the context, and the potential damage if any to the reputation of your employer.

For example if you were involved in a fight and wearing a uniform, then that may well be a dismissal. If no uniform and no one knows who you were and worked for then maybe not a dismissal but still potential disciplinary action.

It really depends, in the incident. .

I am a little confused by this too. I had an argument with a former line manager on Friday, the person has theatened to take this up with HR as gross misconduct. Friday was a day off but I had gone to an industry party during the day - the argument took place in the evening. Can they do that? I didn't come accross as threatening, just told the person how I felt when I worked for them.

Sorry your confused - well as an ex-employee he can't tell you HR dept to fire you for Gross Misconduct. Its up to them to investigate and decide whether there is a case to answer.

He can of course make a complaint - which could then cause the issue to be investigated. Although you dont feel you came across as threatening or harassing him, its down to the way he/she felt that matters.

As the law changed the other week with reference to harassment he may have a valid issue.

I note you say you were on your day off, but attended an industry party. This is similar to Xmas party situation where, as its a work sponsored function then the employer and employees are responsible for their actions and disciplinary action could follow.

So, could argue, eventhough off work, attending the function was an extension of work, and therefore you were representing your firm, and your actions may have brought them into disreput. Thats how you could get to a disciplinary.

Shouldn't worry until your HR dept speaks to you about it if they even do.

Thanks for this Adrian. Yesterday, I apologised for my behaviour and said it was badly timed and unprofessional. However I am refusing to apologise for the content of my words as they are my feelings and nothing really to do with work. I seem to be the first person ever to stand up to this bully and feel a sense of relief. I hope this will help the person become a better manager in the future. If they take it further, so be it. thanks very much again.
