Following the retirement process, we agreed a retirement date with one of our long term employees, ie. 7 May 2008.  Written acceptance and confirmation of the date is available.  The employee has now been taken ill, undergone an operation to remove cancer and it is unlikely that the employee will return to work.


Can we legally retire the employee on the agreed date or would that now constitute unfair dismissal?  What do we do next?  Morally, I don't want to add to the extreme burden now suffered by the employee but we also cannot indefinitely continue to pay the salary.
