Hello All, I'm an interim manager at a not for profit organisation which has just gone through a TUPE transfer. An employee with a long history of sickness absence can no longer perform his duties at a local office 3miles from his home. (I am recruiting for that post). In the meantime the employee wishes to return to work - the staff structure has 1 other vacancy which is suitable but has refused to work there as he claims he cannot travel the 7 miles to that office due to his illness. The organisation has made adjustments in the past and this is also seen as a reasonable adjustment with a phased return. Occupational Health have advised is illness is covered by the DDA. I will be hearing this grievance and he has union rep, Any Advice ? Thanks in advance!

Dear Sir or Madam, Are you certain this person cannot travel the distance to and from work? We specialise in employee issues and would be happy to talk with you regarding your situation. A small amount of surveillance could be a good option. 01483 423900 |
