Hello All,


I'm an interim manager at a not for profit organisation which has just gone through a TUPE transfer. An employee with a long history of sickness absence can no longer perform his duties at a local office 3miles from his home. (I am recruiting for that post). In the meantime the employee wishes to return to work - the staff structure has 1 other vacancy which is suitable but has refused to work there as he claims he cannot travel the 7 miles to that office due to his illness. The organisation has made adjustments in the past and this is also seen as a reasonable adjustment with a phased return. Occupational Health have advised is illness is covered by the DDA. I will be hearing this grievance and he has union rep, Any Advice ?

Are you certain this person cannot travel the distance to and from work? We specialise in employee issues and would be happy to talk with you regarding your situation. A small amount of surveillance could be a good option. 01483 423900
