We have a Ex employee who has left over 5 months ago, They have recently sent in a grievance about the Manager. Does this have to be followed up? When they left the company they had a exit interview with the Manager and filled out a questionnaire one question on our forms is What was your working  relationship with your Manager ? They ticked the very good box when there was other options they could have put.
If we have to follow this up can they go to Tribunal or have they left it too late.

Application to tribunal needs to be made before the end of a 3 month period beginning with the date on which the employment ceased.


Under the current dispute resolution regulations there are exceptions and it is possible to obtain an extension to the time limit for a further 3 months.


But for a tribunal application based on a grievance raised 5 months after employment ceased, that would now be out of time and particularly as at the exit interview no grievance was raised.
