| We have recently employed two non-EEA employees on a part-time basis, 20 hours per week each. They are also students. They have just started doing overtime as their courses are coming to an end. However, I have seen somewhere that non EEA students can not work more than 20 hours per week during term time. Please can someone tell me if this is correct and if this applies during summer vacations. Thank you. | |||

Hi Claire, As I understand how the scheme works non-EEA employees working under a student visa can only work 20 hours per week during term-time. Out of term-time, for example during summer vacations, there is no restriction on the hours students can work. (There may of course be restrictions if they have not opted out of the Working Time Regulations.) If the students are currently working more than 20 hours per week during term time they will be working in breach of their student visas and therefore you must rectify this immediately. It is advisable to write to the education institution to confirm that the students are studying there and ask for details of their term times. This will enable you to ascertain when the students can legally work more than 20 hours per week.
