Hi, If an employer had 2 employees working for him as a couple in his private home in the UK. They were the cleaner, cook, driver etc. As part of thier employment they were provided with an appartment at the Employer's house for them to use while employed at the house. The couple decided to resign and provided the employer with a written one mpnth notice of their resignation as required by their contract. In the process of handing this letter to the employer (Who was abroad at that time) the employee was using bad language such as you are fucking me etc. The employer has therefore so no othe option than to flew special back to the UK and to ask the employees to levae the premesis within 48 hours as he did not want them to stay alone in his property. The employerr has ofcourse agreed to pay the couple their salary for the month's notice he has asked them not to work. Thier contract provided that the employer will be allowed to ask them not to work the notice period. The employer notified the couple that part of this in which they will not be working will be considered their holiday which accrued for the period they worked for. The employees are asling for a month salary (which is agreed by the parties as payment in lieu) as long as payment for their holiday - are they entitled to such payment as they were notified that the notice period in which they were not working is partly used for thier holidays? In addition they are asking for a month rent payment as they were asked to vacate the house within 48 hours and they thought they will be able to stay their for the month. Are they entitiled to such payment as it seems clear that the use of the appartment was only for when they are working and once they termonated their employemt they are not entitled to use it and it should be of no relevance to the employer if they have were to stay or not.
