We have had a new employee start with us on a casual basis. He is from Banglaesh and has a Student Visa type Entry Clearance. Would this pacify that he is allowed to work in the UK? The Clearance does state "No recourse to public funds Work (and any changes) must be authorised"

Hi Clare,


If you amploy a non EU resident worker on a student visa then you must do the following:


1. Write to his place of study and get an official letter confirming that he is enrolled on a course and specifying what the term dates are.


2. During those term dates he can only legally work for you for a maximum of 20 hours.  During the holidays he can work as many as you want (subject to all the various WTR, etc).  It is important to know that it does not matter when his course begins and ends - it is the place of study's published dates that should be used.


This assumes that you have done the ususal immigration checks and satisfied yourself that he is who he says he is.  If you need any more info/help, drop me an email.
