A month ago, my husband got made redundant. He'd already booked 10 days holiday before he was made redundant and then put on "garden leave". Basically although still employed by the company until 15th August, he could no longer access the computer systems and was told he would be better to utilise the time looking for another job. So, regarding the 10 days holiday he had booked.... seeings as he got told of his redundancy before his holiday, would he be entitled to the money for this instead, i.e. as 10 days holiday pay owing to him on top of his final salary? If that makes sense? |

Hi Natasha, Assuming that the company concerned do not have any specific written policies dealing with this type of issue then I would say that the company probably can insist that your husband take the 10 days that he booked; as it was booked prior to any notice being given. He can try and cancel his holiday and ask that they pay him on top when he leaves. At worst they can only say no. Some employers have a clause in their contracts that gives them the right to 'force' employees to take any unpaid leave during a period of notice and if this is true of your husbands employer then they could have made him take it regardless of whether it was booked or not.
