Managing Successful TUPE Staff Transfers

Venue:London
Date:10 February 2010
Description:

TUPE is a complex thing and since its inception attempts have been made to update the regulations in order to clarify their meaning. The most recent change in 2006. However employers still struggle to get it right and must continue to look at new case law to find out how the courts are translating terms such as ‘substantial change in working conditions’ or where TUPE comes into play in a second or third generation transfer.

This conference, another in a series of IRS TUPE conferences, continues to look at the progression of TUPE in the workplace and at tribunal. It has been designed to refresh the knowledge of HR professionals on the basics of TUPE as well explore in depth the more advanced aspects of TUPE and importantly the connotations of new and recent case law. Delegates will also have the opportunity to look at the practical side of handling a TUPE transfer from both the transferor’s and transferee’s perspective and the human impact that it has on an organization before, during and after a transfer.

Highlights include:

  • Refresh your knowledge on the basics of TUPE with a step by step guide to a “typical” transfer
  • Understand how TUPE applies to pensions and the public sector’s ‘Fair Deal’
  • Find out when employee terms and conditions can be changed and understand the implications of relevant new case law
  • Hear the perspective of a Trade Union on when and how they should be consulted during a TUPE transfer
  • Find out how Capgemini, an outsourcer and regular TUPE transferee goes about transferring new staff into their organisation
