I work a 39 week per year contract (school term time). On the other 13 weeks I am unpaid ie laid off. I have now been informed by my employers that they expect me to take my leave during my 13 weeks off when, in theory I'm unemployed. Can they do this? Opinions please.

What does your contract say ? Are they asking you to change your contract terms ?
Usually a term time contract is for 39 weeks but the employee is usually still paid each month (so you would get you annual salary equally over 12 months regardless of the work you did in that calendar month) is this not the case with you ?
You also wouldnt be 'laid off' or unemployed during the vacations - you would simply not be contracted to work any hours.
I think before anyone on here can offer some sound advice we would need to know what your current contract stated with regard to pay and the non working periods
