Help with Counter Schedule of Loss

I have made an ET claim against my ex-employer for constructive dismissal and discrimination. The hearing is still over a month away, but they have just sent me a counter schedule of loss, with quite detailed reasons why they don't think I would receive the losses I have claimed in my schedule of loss. I was wondering if someone could help with a few questions I have about this, as I am representing myself: - Why are they sending this to me at this stage? Wouldn't this usually come up in a remedy hearing? - Do I need to respond in any way? For instance, do I have to put any counterarguments to them at stage? It seems a bit odd to me to be getting into these arguments before the hearing has even been held. - They state I need to show I've mitigated my losses by applying for jobs - do they mean I have to show this now? Or can this wait until the remedy hearing?

I suspect that as the contributors to this site are predominantly HR specialists and not legal specialists you may not get a response. I strongly recommend that you contact ACAS for guidance (type ACAS into any search engine). They will be able to advise from a process perspective, as all the questions relate to the process of the claim and not necessarily the actual claim. You could also try the Directgov ET general enquiry line 0845 795 9775.
