my daughter has returned to work part time after having her 2nd child and told them she had booked a week off in June and paid for it and they will not let her take the holiday they say she should have gone in and told them whilst on maternity leave and apparently all the store were told that they had to book all leave in January but noone phone her to tell her this.
she only actually needs a day off during the week but they will not let her take it or a day off in august on her babies first birthday . Can they do this when a holiday has been pre booked and paid for?? can you only take the holidays when they said or has she rights like when you start a new job please advise asap??

Most companies have an annual leave policy detailing the procedure for booking annual leave, which would usually say that annual leave should be approved before being booked to ensure that the department has enough cover and everyone doesnt book the same times off. It appears that your daughter has booked the holiday without having it approved first. The Company would be in their right to say that she cant have the time off as she didnt follow procedure and have it approved first.
That being said if they Company put out an instruction that all employee's should book their leave in January and your daughter hasnt been informed because she was still on Mat leave,then they failed to properly communicate to her (unless this is standard year in and year out). I would suggest your daughter meets with her manager and goes through an informal resolution to see if they can reach some kind of compromise around her booked holiday, but if they have already said it's not approved it may be that they wont turn back on their decision.
