The CAC The body which supervises the process and may declare a union recognised is the Central Arbitration Committee – an existing and long-standing body which has been revived for this purpose.
The Bargaining Unit The group of employees on behalf of whom a union seeks recognition. Employers may wish to argue for as narrow a group of workers as possible, but the narrower the group the more likely it is that the union will be able to demonstrate the necessary support, and limited recognition may create a disruptive division within the workforce.

Small business exemption The regime only applies to employers of at least 21 employees.
Joint Applications Unions may make joint applications for recognition. This will mainly be used where union membership within the bargaining unit is split between one or more unions and no one union can demonstrate the necessary level of support.
