New
regulations designed to reduce the number of frivolous and vexatious cases
going to employment tribunals are due to come into force on April 18.
The
changes to the existing 1993 regulations have been laid before Parliament and
include an increase in the maximum amount of costs that can be awarded from
£500 to £10,000
The
new regulations also mean that the unreasonable conduct of a party’s
representative may be taken into account when deciding whether to order costs.

The
costs rules are also to be amended so that there is a duty for tribunal
chairman to consider costs where proceedings had no reasonable prospect of
success.
