The majority of HR practitioners believe pensions should be protected under
the Tupe regulations when staff transfer between employers.
Ninety-two per cent of respondents to a Personnel Today poll said the
Government was right to include pension provision in its reform of the Tupe
regulations announced last month, even though this will be a major new cost
burden for businesses.

Making occupational pension rights subject to Tupe was the most radical of
the measures proposed in the DTI’s consultation paper, which has been gestating
for three years.
The Government proposes a variety of models including requiring the new
employer to provide the same type of scheme as the old, or placing restrictions
on the degree of variation in benefits between old and new employer.
