Hundreds report employers to HMRC over furlough fraud

HMRC said it had received 795 reports of employers fraudulently using the furlough scheme

Almost 800 people have reported their employers to HM Revenue and Customs alleging they are fraudulently claiming money from the Coronavirus Job Retention Scheme.

HMRC confirmed it has received 795 reports of potential fraud related to the furlough scheme, which was yesterday extended until the end of October. It will now assess these cases in line with its usual fraud procedures. A spokesperson said the department could not break down the numbers any further at this time.

Under the rules of the furlough scheme, workers must not complete any work for their employer in order for their role to be eligible for the grant, which covers 80% of wages up to a maximum of £2,500 per month.

However, whistleblowing organisations have heard numerous reports from individuals that their employers are asking them to continue to work, despite receiving furlough support.

Liz Gardiner, CEO of Protect, a whistleblowing support body, told Sky News today that the organisation had received a high number of calls to its advice line on furlough fraud.

“We expect this is just the tip of the iceberg,” she said. “In this time of unprecedented change, when people are really worried about their jobs. It’s a really difficult thing to stand up and say ‘I think you’re committing fraud and I’m going to report you’.”

Another group, WhistleblowersUK, said up to a fifth of calls had been from employees in the care sector. Its CEO Georgina Halford-Hall told Sky News: “I’m sure employers are in a very difficult situation not knowing when an invoice might be paid.

“But to put their employees, who are really dedicated to those people they have got to know in the community, in a position where they’re having to choose between committing a criminal act, or not having a job, or not look after the old people they’re caring for, it really is a disgrace, a national disgrace.”

A spokesperson for HMRC said it “is committed to ensuring the tax systems we operate are used fairly and efficiently and where necessary will take action to ensure compliance with the relevant rules, regulations and legislation that govern the UK taxation systems.

“We value all the information provided to us by members of the public aimed at helping us achieve that goal.”

HMRC urges anyone who believes their employer is fraudulently claiming CJRS support to use its digital reporting service. Any information will be treated confidentially and statistical reporting is anonymous.

Announcing the extension to the furlough scheme yesterday, which will also mean staff can return to work part-time from August, chancellor Rishi Sunak said that at least 7.5 million jobs in the UK had been placed on furlough, supporting around 1 million businesses.

    Already. If found and proven guilty they should be closed down for ever and directors banned from opening even a lemonade stand at charity event.

    This is modern slavery and very disgusting.

      Oh come on now, we wouldn’t want to be harsh on those company directors. They have lots of golf to be playing! 😉

      Company directors barely do anything anyway. They just take credit for the staff doing all the work. I agree entirely though but would go one step further, I’d actually give them criminal records.

        Interesting view… As a hard-working, non-golf playing company director myself, I agree that anyone abusing the excellent support provided by the furlough scheme should be dealt with seriously, however, I don’t think broad sweeping statements are helpful.

          Hi…my understanding is that you have to agree with being furloughed…i openly didn’t…and it wasnt discussed.. just told your furloughed…no aggreement signed…so i believe ive been furloughed illegally…and if so is my bosses claim for furlough pay off the government illegal…fraud if you like.. tried to find out online..but can’t find anything …its personal…4 being made redundant…im one of them….

        It is a criminal offence, the legislation was changed in 2017.

        BTW i am a company director and i work my ass of daily, provide jobs for people and pay large tax’s to the government which helps the country through things like this.

        Rather than be look to bash people that are succeeding and helping others try and emulate them, it feels better.

        My work has paid me less during furlough pay claiming I cannot backdate my payments. Does anybody think I should contact HMRC to see if my employer claimed full furlough but paid me less??

    Not only asking them to work, the condition is they have to Pay them within 14 days of the claim or already paid them, some employers asking staff to claim UC while they collect money from HMRC.
    Some they ask they stop them working while claim money and not giving them.

        Hello my friend I’m in same position as you.my company telling me I’m furloughed but I haven’t been paid in 7 weeks now.im on the phone to fraud office tomorrow as I keep being told I’m getting paid but nothing yet so I’m sure he pocketed my furlough money.

        Hi mate if your company has furlough you they have to pay and other thing if your doing part time work for them they have to pay you the days you work and the rest comes from furlough to make up your 80%wages just go to hrmc and look it up and just tell your company your report them to hmrc keep safe

    I had suspect this, my company must have clai.ed and pay less to. Prior to the clai., my rate reflected higher rate but change after the first pay and the co.pany sent a mail sayinng it was wrongly calculate. A subtraction was were made on the subsequent payment which take my wage back to next to nothing as we get paid weekly. Some colleagues even confirm zero payments reflected on their payslips. The taxes and NI deduction does not reflect on my HRMC portal, something is not right, just waiting to see how it plays out.

    I’m a EU immigrant, living in the UK for the past 27th years, working as chef in the hospitality industry and now with corona virus I’ve been put on the furlough scheme , but the problem is that I didn’t get any payment from my current employer.

    He keeps saying that he didn’t get any payment from the government and to hold on with my rent and food.
    Personally I think it’s a ridicule excuse, considering that the government made the application as easy as possible .
    I feel like I’ve been treeded as someone who’s inferior and it’s my fault of the virus turning up in Britain .

        I’ve been working full time and school hols since outbreak got my wages and overtime each month now when I’m paid next week it’s furlough 80% and I can have my 20% and overtime next month surely that isn’t right need some advice

    Can I ask…..are companies allowed to Unfurlough employees to work say 2 days then refurlough them again straight after? I was under the impression it was worked in 3 week instalments?

      No they can’t you must be fuloughed in three week blocks. If they are making you work after 2 days they are breaking the rules!

    The thing is you call HMRC and they will not give you the info as ur not the employer. My company made the claim on the 20th april, my salary date is the 4th may and apparently they still haven’t recd it, until today and it’s now nearly 5PM and I still don’t have the funds. My rent is 3 weeks late, I’ve been shouted by my manager for being persistent etc. This situation is hard but there is no support with regards to the employer being able to check up on the company they work for to see if they are holding funds back. My mental health has deteriorated due to extra unnecessary stress and spending every day in the phone seeking help and trying to manage bills etc.

      I have the same situation. My employer sent me payslip from April but he keep saying that he hasn’t got any money from hmrc yet. And it is 8thJune today. I just called hmrc and they can’t tell me anything about it but they told me I can report it on gov.uk as a fraud

    They government has provided for the business owners rather then the average worker. Many small business not been paid grant as landlord pays the council tax. Making him eligible for grant not the small units his rented out.
    So landlord still gets his rent from small unit holders and the grant from governmment.

      I tried calling HMRC the other week to report the director, but they said they can’t do anything as I’m not in a director’s position. It can only be a director who speaks to them about it, but sadly at my workplace there’s only one director.

    How can i check if the recruitment agency i work for has declared me furloughed and claimed the money through the furlough scheme?
    I have been out of work for 2 and a half months specifically due to corona virus (Kuehne&Nagel greatly effected).
    The recruitment agency is saying i am not entitled to furlough because i turned down work even though i have a full time contract and have been employed for 9 months with a full time contract.
    I have received no p45and the K&N managers are saying the recruitment agency is lying and even wrote me a letter on my request saying the contract has not ended.
    Should i report for fraud?
    I honestly feel like they are claiming the money and keeping it for them selves.

    I get paid two weeks behind last week I got two weeks furlough payout told two weeks this week where with this week it should be 3 weeks I’m owed no monye in bank i text my boss answer was got better things to do as member staff got rushed into hospital he dont know when I’m getting paid how he allowed to get furlough pay and not back date it us .new excuse waiting for furlough pay to go into his bank

    My boss has put us on “furlough” but he/she is still getting us to voluntarily do work. Nobody has said anything as we’re too scared. I tried calling HMRC the other week anonymously to report the director & did my bit, but they did not listen to me at all & said they can only speak the employer on the matter, This is illegal activity & needs to be dealt with. Company directors get away with so much, it’s the ones beneath who get messed around.

    If any company is caught breaching the furlough regulations, they should be struck off & the director disqualified from getting a position as a director in any other company. I’ve seen lots of directors getting fines, but to them that is a slap on the wrist. They need to be punished further.

      Yes, I’m having the same problem. HMRC don’t seem to care. I’ve called them 5 or 6 times but have given up. Left my details but not heard a word, the director is still walking free with (I bet) a smug look on his face knowing he’s able to exploit us & get away with it. Guilty as anything & I even said in my forms when submitting them to HMRC that I’ve got lots of evidence of him not abiding by the furlough regulations but they haven’t once contacted me. Shame on them & shame on my employer!

    Im going through this too. Agency with holding my money. Look on your hmrc tax for this year and you will see how fraudulent your company is really. I have received payment of £350. My online hmrc account is showing iv been payed over 3k since the new tax year. Twitter/social media is a good platform to call out your employer if holding back payments. Il try this first then the fraud squad at hmrc i think. Good luck people.

    I’m receiving my payslips from my work but still have not received one single furlough payment. I cannot claim any benefits either because they are sending me payslips and looks like they are paying me but after explaining to them and offering to show my bank statements as proof, they wont help me. Any one else still waiting for furlough payments?

        Wish I could share your optimism Ian. I’ve reported the director & the company to HMRC a few times within the past 2 months via phone & their online form because we are furloughed but being told to carry out work. However, HMRC haven’t done anything. My latest payslip came through on Friday 29th May & it said I was still a furloughed employee.

    My p60 says £7801.66. I worked out that 80% ÷ 12 months would give me 520 but my emoyer only gives me 316 …what can I do to find out why this is. Employer says an outside payroll company does the pay not them..i feel im being cheated.

    My employer told me to go back to work 3 weeks into lockdown, I worked for a further 3 weeks and made a fuss about it being dangerous, he told me to go back furlough now he is paying me SSP, not a happy chappy, he is obviously ripping hmrc off.

      We are the same. My husband Lost his job just before lockdown but they did not finalise the end to his contract until a few weeks ago. We applied for Universal credit straight away and We have just realised today that this month that we are getting nothing as it says on our UC account that his employer has reported paying him over £5000 !!!!! We have had nothing from them!! We have no money to pay any bills and completely worried if the UC don’t pay when we call to tell them as we have 3 children . We now assume they have been getting his furlough money for months.

    since 02.03.2020 i have git a sick lane and continue until 12.06.2020.i work for restaurant company(ltd.singh)temporary closed on 22.03.2020 after 4 weeks times they open for collection or home deliveries but as i m on sick lane i didnt returned my job alao even if my doctor tell me i can return my job as covid 19 rushed in i m out until end of the october as government information about furlough planning.but before open and after they open they asked me to work i said immposible regarding to my sick lane and waiting on longlist at hospital for scan…but before furlough about 15th of the march company reported to hmrc 1365£ income related me.but i work for him part time and raffly 610 £ between 620£.however apparently he s done this grabb more money with my name as a furlough %80 percent after mr.rishy sunak information about employers and employees.but company first furlough payment was on 8th of may after 47 days later only 534£ .i wrote him by whats up a lot regarding matter also he s reporting hmrc he shows on my payslip that hes paying me sick lane (ssp)but he s not giving me any penny.he didnt pay a single penny.also after all this matter universal credit stopped my benefit on march reason is company reported big amount money as my income as soon as i called universal credit they told me i should speak with my employer to fix problem and mistakes being taken,and i take this as advice i let company about it all…they said accountant mistake which is accountant wouldnt do mistake as employer reporting accountant as well unfortunately i learned this is an employer fraud.now i started new fresh claim while i m not working as universal credit but on march i lost my house rent,ssp payment half from government as usually employer was covering half of my ssp.as they didnt pay a penny yet.after all this matter 2 days ago i said to company owner face why you did this and i will complain about you and the company.he urgently transfer another 309£as furlough to my bank account so he know it whats he doing.now i m asking him do my payments as i need it and his business doing ok but hes not paying my ssp.also i asked him if you dont pay my money i never return my job while i love doing my job because if i return it dies mean i accepted all hus fraud and cheating on my pays.so i asked him nicely pay my money or you give me notice with also paying 2 weeks notice wages,this year (11)month holiday payment and my ssp payments with sending my p45.so i can let government know that i lost my job because i m againest my employer fraud.(company cheating)anybody can advice faster procedure or way to follow please advice me.thank you for reading and answering…

    Can I check if my old company is claiming furlough using my details? , as I was to be starting a new job in April when this all happened. Called my old boss to put me back on payroll as advised by HMRC but she declined. So I have been without job and no pay since end of feb. I suspect something is not right but don’t really have anyway to prove she is doing it. Would be nice to know if I could check if she is actually making any claims.

    WHAT IS THE TELEPHONE NUMBER OR EMAIL ADDRESS TO REPORT AN EMPLOYER? I am pretty sure a company l know is abusing the scheme but hard to get proper contact details to report anonymously. I see Protect and Liz Gardener all over the Internet but no contact details. How are people supposed to report this when they do not have details?

    The company I work for have used this to cull there external sales force by putting them all on furlough at the end of March and taking email and phone access of most of them except a few favourites who were encouraged (and expected) to continue working from home and were told that they would make up the extra 20% if they did this. The others were only ever contacted by emails saying that they are looking at redundancies and also phone calls from the sales director saying that he was disappointed that they are not in touch every day. The 3 ‘favourite’ sales people are still on furlough but are answering phone calls, sending in emails and even attending work and having meetings with customers. They have been told that they are the future and their commitment will mean they have a job. Incidentally, even the MD furloughed himself for over a month but still came into the office every single day 8 till 5. I am not one of these people but I am angered by the fraud and the bullying that this company demonstrates every single day.

      I forgot to add that the Sales Director is also, himself, claiming furlough money from the government and UK taxpayer while still working from home and also the main office.

    Ok so I’m working full time and have been since day one of lockdown, however my employers are only paying me the same amount as I’d get if I was on furlough…. as I earn over 2500 a month I’m actually only receiving 60% of my wage…. i know it’s not fair and feel I’m being used but can they legally do this?

      Hi no if your working full time they have to pay you your normal
      Wage mate not furlough wage if your with a union phone them
      If not go on line and look for one and also tell your company
      You want the rest of your wages if not your take them to court
      It will cast them more in the end there robbing you mate

    I work for a hospitality agency full time, I was sick from the 2nd week of March, tried to claim sick pay, they accepted the sick note, told me to wait until the end of April then denied me saying, because I would be put on furlough I wasnt able to claim sick pay for those 2 weeks, though the furlough scheme payments did not cover the period I was sick. They have not sent any documentation outlining the details of their intentions with furlough or how they will be claiming on my behalf. End of April a random of money landed my account not sure what period it was for, 2 days before the 2nd payment an email was sent put stating that somehow they’ve over paid so the 2nd payment will be about 1/3 less, instead of claiming for 5 weeks they some how claimed for 8. They are also still actively operating sending out emails for jobs, constantly ringing, when I dont respond in their time frame they decide to WhatsApp me since email and calling wasnt enough. They also mentioned at the beginning of the scheme the office staff were furloughed and will not be taking any phone calls or emails from the hospitality staff but will be in touch whenever they gained information from the government. The 1st email I received was a general email sent to all the hospitality staff stating we are on furlough and to expect 1st payment end of april. I have no clue what they are claiming on my behalf or since the 2 previous payments differ if I’m getting the correct amount.

    I was furloughed in march, And in the past 12 weeks I have been paid my furlough once. My boss keeps saying he hasnt been sent any money is there anyway I can check online?

      My daughter has the same problem, furloughed but only received 1 payment since March, reluctant to report employer in case he genuinely hasn’t received the grant from government

    My employer has been paying 80% on time since march but suddenly it is 1st of July and no-one has got any payment . I don’t understand how he can say now he did not receive the money yet to pay us ,to be honest I think he is trying to push us to leave the job

      I was recently very ill with covid 19
      Ive since made a full recovery !
      After returning to work for 2weeks i was put on thurlow with 4 other guys ! My gripe is a week earlier a colleague went into hospital for a operation and was signed off for up to 6months , he was claiming ssp fot 2 weeks then my boss said he would put him on thurlow pay until he can start back at work ! Surly this isnt allowed

    I think govt should put up system where every individual can see on National Insurance No how much HRMC paid every individual under CJRS.
    I think govt will do this soon.

    i have a feeling my boss has furloughed me illegally as he wont allow me to login into my mot account since lockdown but dont know how to find out if he has! i know he has furloughed one staff member but has still been in work all through lock down! can anyone help

    i was working 30-45 hours a week.
    On my last month these hoursremained for the first 2 weeks, then the 3rd week I booked 2 days off (I received no holiday pay).

    When I came back to work at the weekend i collapsed at work at work in the cellar.
    They gave me the remainder of this time off. I had no income. I’m now earning 119.50 a week on furlough however this stopped on the 01 June 2020.

    They’ve asked me to work whilst being furloughed to “help me out”.

    I’ve asked for my payslips of my furlough however at first she said she couldn’t do them.

    I’ve asked recently for my p45 and she’s still not sent it.

    I asked when I’d be working again and she said “when there’s no social distance measures”.

    Please can anybody help me with information about this?

    I feel like they’re claiming my furlough for themselves as on June 1st.

    HMRC apparently stated that employers “found guilty” of furlough fraud will have to repay it back. That’s not enough, that’s a slap on the wrist. They should be giving the directors criminal records & ban them from ever becoming company directors. My scum of a director has somehow been able to extend our supposed furlough even though I reported him several times. HMRC are incompetent & anyone thinking they can rely on them, sorry but you are wasting your time.

    This furlough scheme has been done to benefit the scummy company directors. For any company directors who genuinely have had to furlough employees due to no work, I credit you but sadly a very large minority have tarred you all under the same brush. Unless they get dealt with, company directors will always have this negative image.

    Can anybody help me please. I wasn’t furloughed but my employers refused to furlough us. Our choice was stay and work reduced hours (35% less) or leave and claim universal credit. I stayed and worked part-time through the whole thing. Would I be eligible for the part-time furlough scheme to top up my part-time wages (80% of the difference) or does it not work like that?

    My son works for Yorkshire Boilers in Wakefield, West Yorkshire, he is on furlough and has just been given his 3

    weeks notice, they have used his holiday money as part of his payment, how low, they have office staff on furlough but still work 6 hours a day.

    These shitty firms should be fined.

    I started a new company on 16th March and was furloughed the following week. I have been paid only 50% of my wages, which they say it because I had a previous job (which actually paid me more). Went to check my bank account day and no wage at all has been paid.

    Some of our colleagues payslips says furloughed on them. However only one person has ever been furloughed, the rest have worked all the time. The manager when challenged about the payslips being wrong said but your pay is right what’s the problem?.
    We have on many occasions had our payslips say we were sick for a day but we’re not could this be some sort of fraud?
